1. Operator and role

A&A-EUcoins operates an online marketplace. Sales are between seller and buyer and item payments are direct. Mandatory statutory platform duties remain unaffected.

A&A-EUcoins is not the commercial, payment-receiving, or contracting agent of either party and has no authority to bind a seller or buyer outside the expressly described platform functions.

2. Account

One account can buy and, after separate verification, sell. Users must be 18+; accounts and access are non-transferable.

3. Auction access

Buyer Auction Access is a paid platform service with a total price of €30 including applicable VAT. It enables bidding for 12 months from confirmed payment, does not renew automatically and is not a deposit, account balance or contractual penalty. Terms and withdrawal form: Auction access terms and Withdraw from contract.

Consumers may withdraw from the platform contract within the statutory period through Withdraw from contract. A request for immediate performance does not by itself end the withdrawal right; after performance begins, only statutory consequences and any legally permitted proportionate compensation apply.

4. Bids, payment and non-payment

Winning bids are binding. The winner pays the seller directly within 72 hours, marks the transfer in the order and keeps bank evidence. A&A-EUcoins does not accept item payments.

A non-payment report starts human review. Buyer and seller may provide evidence and explanations; the lot is not reassigned before a decision. Confirmed non-payment may end the order and temporarily restrict new bidding; the reasoned decision can be appealed. Buyer Auction Access remains an access service: €30 is neither automatically withheld nor treated as a contractual penalty.

Any seller claim based on default, termination or proven loss depends on applicable law and the individual facts. A&A-EUcoins does not impose a fixed contractual penalty or decide private monetary claims.

4a. Seller success fee

A&A-EUcoins charges a 5% net fee on the successfully paid final item price, excluding shipping. It arises after the seller confirms receipt or a documented moderation review establishes receipt despite a non-payment report. An auction result alone does not trigger the fee. Unpaid, cancelled and fully refunded deals carry no fee; a completed reversal credits an accrued fee. A false non-payment report may be a separate rules breach but never creates a penalty surcharge. Findings are reasoned and appealable. A calendar month's fee of €1 or less is waived and a total balance below €10 is carried forward. Statements are monthly and payable within 14 days. New publishing is blocked after the due date; five days later, catalogue listings and auctions without bids may be hidden until payment is confirmed and are then restored automatically. Live auctions with bids are not interrupted. VAT treatment follows the actual service supplied, the recipient's verified status and location, and all statutory conditions. Reverse charge is not applied merely because a VAT ID was entered. No invoice is issued automatically until tax data are confirmed. The rate, tax treatment and terms version are stored at accrual and are not changed retroactively.

5. Sellers

Private or trader status is displayed. Traders provide mandatory pre-contract information. See Seller rules.

6. Consumer rights

Trader-to-consumer distance sales may carry statutory withdrawal and warranty rights. An online-only auction does not automatically remove them. Consumer rules may not apply to private sellers.

6a. Reviews

The buyer and seller may each submit one personal review within seven days after an order is completed. A&A-EUcoins sends reminders after 24 and 48 hours. If no personal review is submitted, after seven days the platform publishes a clearly labelled positive completion note without stars. It is not written by a participant and is excluded from the rating average. For personal reviews, A&A-EUcoins verifies the transaction link, not the truth of every subjective statement. Hidden or unlawful reviews are excluded from the public score after documented review (UWG section 5b(3)).

7. Moderation

Reports are assessed on content and context. Restrictions are reasoned and appealable; report count alone never triggers a sanction.

8. Liability

A&A-EUcoins is not a party to the item sale, takes no title or possession, does not physically inspect the item, and does not accept the item payment. The relevant seller is responsible for title, lawful provenance, authenticity, description, price, packaging, shipping, import/export, taxes, statutory conformity, and sale refunds; the buyer remains responsible for payment and cooperation duties.

A&A-EUcoins remains fully liable for intent and gross negligence, death or personal injury, liability under mandatory product-liability rules, and every other non-excludable liability. For slight negligence affecting an essential platform-contract duty, liability is limited to typical foreseeable loss; liability for other slight negligence is excluded to the extent permitted by law.

Statutory duties under the DSA, data-protection, consumer, and product-safety law are not excluded. A&A-EUcoins does not guarantee a sale outcome, uninterrupted availability, or delivery of a bid where causes are outside its reasonable control; mandatory and essential duties of A&A-EUcoins remain unaffected.

9. Complaints

Notice, decision, and appeal information: Notices, decisions and appeals. Dispute-resolution statements reflect only the operator's actual legal position and configuration.

10. Order chat and quick replies

To prevent fraud, links, email addresses, phone numbers and bank details are not sent in the chat; the counterparty’s contact and payment details are shown in the order. After receipt is confirmed the chat stays open for 72 hours; withdrawal, disputes and contact details remain available in the order. The order chat is provided to complete the relevant transaction. Messages are not end-to-end encrypted. Authorised staff may access them only to handle a report, dispute, security incident or lawful request; access is logged.

Quick replies are editable templates. Selecting one only inserts text into the composer; it is sent only after the user separately selects “Send”. The user remains responsible for the content of the message they send.

11. Mandatory law and cooperation

No term excludes criminal or regulatory liability or requires A&A-EUcoins to facilitate known fraud. Where specific, credible indicators exist, A&A-EUcoins may and, where legally required, must preserve or restrict listings and functions, preserve evidence, notify affected persons, and cooperate with competent authorities within the statutory scope. A report alone does not prove guilt; decisions remain documented, proportionate, and appealable where the law requires.

12. Prohibited listings and cooperation

Prohibited items include stolen or counterfeit goods, unlawfully exported or imported cultural property, sanctions-prohibited goods, unsafe products, and any item the seller has no right to dispose of. Sellers must retain and, on a reasoned request, provide applicable provenance, title, import/export, product, and packaging evidence. A&A-EUcoins may preserve or restrict a listing, notify an authority, or preserve relevant evidence where legally required or proportionate following a documented risk assessment.

13. Authorities, courts, and evidence

Users must answer lawful A&A-EUcoins requests concerning a specific case truthfully and preserve existing evidence without alteration. A&A-EUcoins verifies authority requests, discloses only necessary data on a valid legal basis, logs access and disclosure, and informs affected persons unless law prohibits notice. A&A-EUcoins does not determine criminal guilt or adjudicate private damages; authorities and courts do so.

14. Business-user indemnity

Only to the extent permitted by law, a business user indemnifies A&A-EUcoins against substantiated third-party claims caused by that user's culpably unlawful item, content, or contractual breach. It does not cover loss caused by A&A-EUcoins and does not reverse a statutory burden of proof. No blanket indemnity applies to consumers.

Free periods and trial participation

The platform may grant a global free period for existing and new accounts, a period following registration or an individual benefit. Free buyer access and waiver of seller commission are separate benefits. Applicable services and expiry dates appear in your account. Durations in months are calculated in calendar months from the start of the relevant benefit. Seller verification and account restrictions still apply. Buyers pay sellers directly for goods and shipping; these are not free platform services.

Orders opened during a seller commission waiver remain commission-free even if receipt of payment is confirmed later. Existing invoices remain payable. Disabling new registration benefits does not shorten previously granted periods. Ending a global period or individual benefit early changes future eligibility while preserving the history of commission-free orders. After expiry, the regular terms apply: 5% seller commission excluding shipping and €30 buyer access for 12 months. Previously purchased access remains valid until its own expiry. There is no automatic charge or renewal.

When trial participation is enabled, a buyer can unlock 3 different auction lots free of charge per period. By default, the allowance renews every 30 days from the start of trial participation. Your account shows the current interval and next renewal date. The platform may change the interval or disable new trial participation. Further bids on already unlocked free lots do not use another slot and remain available when trial access is disabled, unless the account is restricted. Unused slots do not accumulate. When the allowance is exhausted, buyers can wait for renewal or purchase annual access separately.

Themed banners

Numismatics, coin collecting and related goods or services only. You must hold usage rights and provide truthful information. Unlawful offers, deception, counterfeits and other people’s personal data are prohibited. All banners are moderated; changes require a new application.

Final price in EUR including applicable taxes. One banner occupies one of up to three homepage slots, assigned by rotation. The term starts after payment; views, clicks and sales are not guaranteed.

I have the right to publish these materials and accept the placement rules and public identification of the advertiser and payer.

I request placement immediately after payment, before the 14-day withdrawal period ends.

Where consumer withdrawal rights apply, withdrawal after service starts requires proportionate payment for service provided. On full performance the right ends with my consent. I will contact support for withdrawal or refunds.

Available rates and prices are shown before ordering (by default 7 days €7, 30 days €20). No subscription or automatic renewal. Applications are free; payment follows moderation if a slot is available. Rejected applications are not charged. Operator and contact: Impressum. Withdraw within 14 days of contract conclusion by an unambiguous message to support; no mandatory form. Refunds use the original payment method without undue delay, within 14 days of notification. Mandatory consumer rights remain unaffected. Banners are labelled as advertising; advertiser and payer are public.

Electronic agreement for platform and promotional services

A&A-EUcoins conducts online trade, provides an e-commerce platform and supplies marketing and advertising services (such as product placement and promotional campaigns) to sellers. The order specifies the service purchased, its price and duration. A seller success fee and separately purchased promotion are different services.

Services are ordered electronically with confirmation of the applicable terms. Business status, billing details and tax treatment are checked for paid promotion. The service description, consent, applicable terms version and tax details are recorded at order time. Paid service commencement follows the selected tariff and server-side payment confirmation; opening a payment success page alone does not activate a service.

Tax grounds are determined for each transaction. German small-business exemption under UStG section 19, reverse charge and a transaction outside German VAT are different grounds, not one universal zero rate. Unconfirmed cases are reviewed before payment. A payment receipt confirms payment; a separate invoice is available in service history. Refunds require payment-provider confirmation; financial records are corrected through separate documents.

Service balance. Sellers may top up a balance in advance (€10 to €2,000) and use it to pay for A&A-EUcoins’ own services: promotion, shop ads, PRO and banners. A top-up is a prepayment, not an item payment; it is not electronic money, cannot be transferred to other users, cannot be used for payments between buyers and sellers and earns no interest. Each service paid from the balance is listed with its service date on the monthly statement together with the fee as already paid. Unused balance is refunded on request within 14 days, without deductions, to the original payment method or the seller account; A&A-EUcoins may set it off against overdue claims (section 387 BGB). The balance does not lapse. After 24 months without sign-in the seller is notified; without a response within 30 days the wallet is closed and the remainder refunded. The repayment claim for an unclaimed balance is subject to the regular limitation period (sections 195, 199 BGB).

Commission payments from the wallet. Available funds can be used for issued commission invoices through a separate payment button. Automatic payment is off by default, requires separate activation and can be disabled at any time. The mandate covers existing and new commission invoices only from available funds; it does not authorise card or bank charges or automatic top-ups. Insufficient funds do not cancel outstanding debt. Paying a commission from the wallet does not invoice that same service again. Bonus points are kept separate from euros, do not settle monetary debt and cannot be exchanged for money. Review ratings are separate from bonus points; points for an eligible review do not depend on a high or low star rating.

Platform tax reporting (PStTG/DAC7)

Payment directly to a seller does not, by itself, exempt a platform from PStTG/DAC7 duties. Where reporting-platform duties apply, the law requires seller information to be checked and prescribed data to be submitted to the competent tax authority. In Germany this is the Bundeszentralamt für Steuern (BZSt).

For sales of goods, the small-activity exclusion applies only if both conditions are met during the reporting period: fewer than 30 sales and less than €2,000 in total consideration paid or credited. Exactly 30 sales or exactly €2,000 do not meet this exclusion. These are reporting thresholds, not tax-free income allowances.

Where the law applies, reporting covers the identity or company details, address, tax identifiers and residence required by section 14, together with available financial-account details and quarterly consideration, transaction counts and fees charged. These details are not published in listings. Reporting is generally due by 31 January of the following year; sellers receive the legally required information about the reported data. Records are retained for ten years from the end of the year they were created. Individual records under section 24(1), points 2–5, are then deleted unless another applicable legal basis requires retention.
